শর্তাবলী:

জোমেক্স -এ আপনাকে স্বাগতম, যা "আমরা", "আমাদের" বা "জোমেক্স" নামেও পরিচিত। আমরা এমন একটি জায়গা তৈরি করার জন্য যথাসাধ্য চেষ্টা করি যেখানে আপনি নিরাপদ এবং সুরক্ষিত পরিবেশে আপনার পছন্দের জিনিসগুলি অন্বেষণ এবং কেনাকাটা করতে পারেন। এই সাইটটি ব্যবহার করার আগে দয়া করে এই শর্তাবলী সাবধানে পড়ুন। সাইটটি ব্যবহার করে, আপনি এতদ্বারা এই শর্তাবলী স্বীকার করছেন এবং প্রতিনিধিত্ব করছেন যে আপনি এই শর্তাবলী মেনে চলতে সম্মত। এই সাইটটি জোমেক্স ট্রেডিং লিমিটেড কোম্পানির মালিকানাধীন এবং পরিচালিত (নিবন্ধন নম্বর: C-195194/2024)।

সদস্যপদ লাভের যোগ্যতা:

এই সাইটের ব্যবহার কেবলমাত্র সেই ব্যক্তিদের জন্যই প্রযোজ্য যারা প্রযোজ্য আইনের অধীনে আইনত বাধ্যতামূলক চুক্তি করতে পারেন। যদি আপনি নাবালক হন, ১৮ বছরের কম বয়সী কিন্তু কমপক্ষে ১৪ বছর বয়সী হন, তাহলে আপনি কেবলমাত্র একজন পিতামাতা বা আইনি অভিভাবকের তত্ত্বাবধানে এই সাইটটি ব্যবহার করতে পারেন যিনি এই শর্তাবলী মেনে চলতে সম্মত হন। যদি আপনার বয়স ১৮ বছরের কম হয়, তাহলে আপনার পিতামাতা বা আইনি অভিভাবকরা আপনার পক্ষে লেনদেন করতে পারবেন যদি তারা নিবন্ধিত ব্যবহারকারী হন। প্রাপ্তবয়স্কদের ব্যবহারের জন্য এমন কোনও সামগ্রী কেনা আপনার জন্য নিষিদ্ধ, যা নাবালকদের কাছে/দের দ্বারা বিক্রি বা ক্রয় করা কঠোরভাবে নিষিদ্ধ।

জোমেক্স আপনার সদস্যপদ বাতিল করার এবং সাইটে আপনাকে অ্যাক্সেস প্রদান করতে অস্বীকার করার অধিকার সংরক্ষণ করে যদি জোমেক্স জানতে পারে যে আপনার বয়স ১৮ বছরের কম বয়সী।  সাইটটি সেই ব্যক্তিদের জন্য উপলব্ধ নয় যাদের সদস্যপদ জোমেক্স দ্বারা যেকোন কারণে স্থগিত বা বাতিল করা হয়েছে। আপনি যদি একটি ব্যবসায়িক সত্তা হিসাবে নিবন্ধন করেন, তাহলে আপনি প্রতিনিধিত্ব করেন যে এই ব্যবহারকারী চুক্তির সাথে সত্তাকে আবদ্ধ করার ক্ষমতা আপনার আছে।

আপনি যদি সাইটটি ব্যবহার করেন, তাহলে আপনার অ্যাকাউন্ট এবং পাসওয়ার্ডের গোপনীয়তা বজায় রাখার জন্য এবং আপনার কম্পিউটারে অ্যাক্সেস সীমাবদ্ধ করার জন্য আপনি দায়ী এবং আপনার অ্যাকাউন্ট বা পাসওয়ার্ডের অধীনে সংঘটিত সমস্ত কার্যকলাপের জন্য আপনি দায়বদ্ধ থাকবেন। আপনার পাসওয়ার্ড বা অ্যাকাউন্ট সুরক্ষিত করতে আপনার ব্যর্থতার ফলে যে কোনও ক্ষতি বা ক্ষতি হতে পারে তার জন্য জোমেক্স কোনও ব্যক্তির কাছে দায়বদ্ধ থাকবে না। যদি আপনি জানেন বা সন্দেহ করেন যে অন্য কেউ আপনার পাসওয়ার্ড জানে, তাহলে আপনার নীচের ঠিকানায় অবিলম্বে আমাদের সাথে যোগাযোগ করে আমাদের অবহিত করা উচিত। যদি জোমেক্স বিশ্বাস করে যে জোমেক্স সাইটের নিরাপত্তা লঙ্ঘন বা অপব্যবহার হওয়ার সম্ভাবনা রয়েছে, তাহলে আমরা আপনাকে আপনার পাসওয়ার্ড পরিবর্তন করতে বলতে পারি অথবা আমরা জোমেক্স এর প্রতি কোনও দায়বদ্ধতা ছাড়াই আপনার অ্যাকাউন্ট স্থগিত করতে পারি।

পণ্য এবং মূল্য নির্ধারণ:

সমস্ত মূল্য বাংলাদেশী টাকায় (BDT) তালিকাভুক্ত এবং ভ্যাট সহ এবং পণ্য বা পরিষেবা বিক্রিকারী বিক্রেতা দ্বারা সাইটে তালিকাভুক্ত করা হয়। জোমেক্স আপনার অর্ডার না দেওয়া পর্যন্ত কোনও পণ্যের মূল্য নিশ্চিত করতে পারে না। কোনও পণ্য কেনার আগে সম্পূর্ণ পণ্য তালিকা পড়ার জন্য আপনার দায়িত্ব। আপনার ক্রয় নিশ্চিত করার মাধ্যমে, আপনি সমস্ত প্রযোজ্য ফি, কর, শিপিং খরচ এবং আপনার ক্রয়ের সাথে সম্পর্কিত অন্যান্য পরিমাণ পরিশোধ করতে সম্মত হন। আপনার শপিং কার্টে থাকা আইটেমগুলি সর্বদা আইটেমের পণ্যের বিবরণ পৃষ্ঠায় প্রদর্শিত সাম্প্রতিকতম মূল্য প্রতিফলিত করবে। অনুগ্রহ করে মনে রাখবেন যে এই মূল্যটি আপনি যখন প্রথমবার আপনার কার্টে আইটেমটি রেখেছিলেন তখন দেখানো দামের থেকে আলাদা হতে পারে। আপনার কার্টে কোনও আইটেম রাখলে সেই সময়ে দেখানো দাম সংরক্ষণ করা হয় না। এটিও সম্ভব যে কোনও আইটেমের দাম আপনার ঝুড়িতে রাখার সময় এবং কেনার সময় হ্রাস পেতে পারে। তবে, কখনও কখনও অনলাইনে কোনো মূল্য কোনো দোকানের দামের সাথে মেলে না। আপনার নির্দিষ্ট ভৌগোলিক অঞ্চলে সর্বনিম্ন মূল্য প্রদানকারী হওয়ার আমাদের প্রচেষ্টায়, স্টোরের দাম কখনও কখনও অনলাইন মূল্যের থেকে আলাদা হতে পারে। মূল্যএবং প্রাপ্যতা নোটিশ ছাড়াই পরিবর্তন সাপেক্ষে।

আমরা যেকোনো সময় কোনো বিজ্ঞপ্তি ছাড়াই যেকোনো পরিষেবা (অথবা এর যেকোনো অংশ বা বিষয়বস্তু) পরিবর্তন বা বন্ধ করার অধিকার সংরক্ষণ করি। পরিষেবার যেকোনো পরিবর্তন, মূল্য পরিবর্তন, স্থগিতকরণ বা বন্ধ করার জন্য আমরা কোনও গ্রাহক বা কোনও তৃতীয় পক্ষের কাছে দায়বদ্ধ থাকব না।

অনলাইন স্টোর থেকে কেনাকাটা করার জন্য সঠিক অর্থপ্রদানের পদ্ধতি নির্বাচন করা অপরিহার্য।

আপনার জমা:

এই সাইটে বা এর মাধ্যমে জোমেক্স-এ প্রকাশিত, জমা দেওয়া বা দেওয়া সকল পর্যালোচনা, মন্তব্য, প্রতিক্রিয়া, পোস্টকার্ড, পরামর্শ, ধারণা এবং অন্যান্য জমা দেওয়া অথবা এই সাইটের আপনার ব্যবহারের সাথে সম্পর্কিত অন্যথায় প্রকাশ, জমা দেওয়া বা দেওয়া (সম্মিলিতভাবে, "মন্তব্য") জোমেক্স-এর সম্পত্তি হবে এবং থাকবে এবং আপনাকে ফেরত দেওয়া হবে না।যেকোনো জমা দেওয়ার ক্ষেত্রে প্রযোজ্য অধিকার ছাড়াও, যখন আপনি সাইটে মন্তব্য বা পর্যালোচনা পোস্ট করেন, তখন আপনি আমাদেরকে এই ধরনের পর্যালোচনা, মন্তব্য বা অন্যান্য সামগ্রীর সাথে সম্পর্কিত আপনার জমা দেওয়া নাম ব্যবহার করার অধিকারও প্রদান করেন। আপনি কোনও মিথ্যা ই-মেইল ঠিকানা ব্যবহার করবেন না, নিজেকে ছাড়া অন্য কেউ বলে ভান করবেন না বা অন্যথায় কোনও জমা দেওয়ার উৎস সম্পর্কে আমাদের বা তৃতীয় পক্ষকে বিভ্রান্ত করবেন না। জোমেক্স এবং এর সহযোগীরা আপনার বা কোনও তৃতীয় পক্ষের দ্বারা জমা দেওয়া কোনও মন্তব্যের জন্য কোনও দায়িত্ব নেবে না এবং কোনও দায়িত্ব গ্রহণ করবে না।

যোগাযোগ:

যখন আপনি সাইটটি পরিদর্শন করেন বা আমাদের কাছে ইমেল বা অন্যান্য ডেটা, তথ্য বা যোগাযোগ পাঠান, তখন আপনি সম্মত হন এবং বোঝেন যে আপনি আমাদের সাথে ইলেকট্রনিকভাবে যোগাযোগ করছেন। আপনি আমাদের কাছ থেকে ইলেকট্রনিকভাবে যোগাযোগ গ্রহণ করতে সম্মত হন। আমরা আপনার সাথে ইমেল বা সাইটে বিজ্ঞপ্তি পোস্ট করে যোগাযোগ করব। আপনি সম্মত হন যে আমরা আপনাকে যে সমস্ত চুক্তি, নোটিশ, প্রকাশ এবং অন্যান্য যোগাযোগ ইলেকট্রনিকভাবে প্রদান করি তা এই ধরনের যোগাযোগ লিখিতভাবে হওয়ার আইনি প্রয়োজনীয়তা পূরণ করে।

তৃতীয় পক্ষের লিঙ্ক:

আমাদের পরিষেবার মাধ্যমে উপলব্ধ কিছু সামগ্রী, পণ্য এবং পরিষেবার মধ্যে কেবলমাত্র আপনাকে আরও ভাল পরিষেবা প্রদানের উদ্দেশ্যে তৃতীয় পক্ষের সম্পূর্ণ বা আংশিক উপকরণ অন্তর্ভুক্ত থাকতে পারে। এই সাইটের তৃতীয় পক্ষের লিঙ্কগুলি আপনাকে এমন তৃতীয় পক্ষের ওয়েবসাইটগুলিতে নির্দেশিত করতে পারে যা আমাদের সাথে সম্পর্কিত নয়। আমরা বিষয়বস্তু বা নির্ভুলতা পরীক্ষা বা মূল্যায়ন করার জন্য দায়ী নই অথবা তৃতীয় পক্ষের সামগ্রী, ওয়েবসাইটের সামগ্রী, পরিষেবা বা তৃতীয় পক্ষের অন্য কোনও উপকরণের জন্য কোনও দায়বদ্ধতার নিশ্চয়তা দিই না।

কোনও তৃতীয় পক্ষের ওয়েবসাইটের সাথে সম্পর্কিত পণ্য, পরিষেবা, সংস্থান, সামগ্রী বা অন্য কোনও লেনদেনের ক্রয় বা ব্যবহার সম্পর্কিত কোনও ক্ষতি বা ক্ষতির জন্য আমরা দায়বদ্ধ নই। দয়া করে তৃতীয় পক্ষের নীতি এবং অনুশীলনগুলি সাবধানে পর্যালোচনা করুন এবং কোনও লেনদেনে জড়িত হওয়ার আগে নিশ্চিত করুন যে আপনি সেগুলি বুঝতে পেরেছেন। তৃতীয় পক্ষের পণ্য বা পরিষেবা সম্পর্কিত কোনও অভিযোগ, দাবি, উদ্বেগ বা প্রশ্ন তৃতীয় পক্ষের কাছে পাঠানো উচিত। আমরা আপনাকে সমস্ত তৃতীয় পক্ষের শর্তাবলী এবং গোপনীয়তা নীতিগুলি পড়ার জন্য দৃঢ়ভাবে পরামর্শ দিচ্ছি।

ছাড় এবং ভাতা:

ডিসকাউন্ট এবং ভাতা (কুপন কোড, প্রোমো কোড, গিফট কার্ড কোড, লয়্যালটি প্রোগ্রাম, অ্যাপ ডিসকাউন্ট বা সাইন-আপ অফার ইত্যাদি) হল পণ্য বা পরিষেবার মূল মূল্য হ্রাস। zomex.com.bd থেকে সফলভাবে অর্ডার করার পরে রিটার্ন বা এক্সচেঞ্জে ডিসকাউন্ট কুপন বা গিফট কার্ডের মূল্য ফেরত দেওয়া হবে না। একই সেল ফোন নম্বর বা ইমেল ঠিকানার অধীনে একাধিক অ্যাকাউন্ট থাকা ব্যবহারকারীরা একাধিকবার ছাড় বা অফার উপভোগ করতে পারবেন না। প্রচারমূলক এসএমএসে শুধুমাত্র অফারের মূল বিষয়বস্তু থাকতে পারে তবে ওয়েবসাইটে নিয়ম ও শর্তাবলী  উল্লেখ করা আছে।

জোমেক্স পূর্ব বিজ্ঞপ্তি ছাড়াই যেকোনো ডিসকাউন্ট অফার বা প্রচারমূলক ভাতা পরিবর্তন/সংশোধন/পরিবর্তন করার অধিকার রাখে। গ্রাহকরা একক অর্ডারে একাধিক ডিসকাউন্ট অফার উপভোগ করতে পারবেন না।

প্রতারণামূলক/অস্বীকৃত লেনদেন:

জোমেক্স সাইট প্রতারণামূলকভাবে ব্যবহারকারী ব্যক্তিদের কাছ থেকে পণ্য সংগ্রহের খরচ এবং আইনজীবীর ফি আদায় করার অধিকার সংরক্ষণ করে। জোমেক্স সাইটের প্রতারণামূলক ব্যবহার এবং এই শর্তাবলী লঙ্ঘন করে অন্য কোনও বেআইনি কাজ বা ভুলের জন্য এই ধরনের ব্যক্তিদের বিরুদ্ধে আইনি ব্যবস্থা গ্রহণের অধিকার সংরক্ষণ করে। কোনও লেনদেনের অনুমোদন প্রত্যাখ্যানের ফলে প্রত্যক্ষ বা পরোক্ষভাবে উদ্ভূত কোনও ক্ষতি বা ক্ষতির জন্য আমরা একজন ব্যবসায়ী হিসেবে কোনও দায়বদ্ধ থাকব না, কারণ কার্ডহোল্ডার সময়ে সময়ে আমাদের অধিগ্রহণকারী ব্যাংকের সাথে পারস্পরিকভাবে সম্মত পূর্বনির্ধারিত সীমা অতিক্রম করেছে।

নিষিদ্ধ ব্যবহার:

আপনি সম্মত হচ্ছেন যে আপনি পরিষেবাগুলি আপনার নিজের ব্যবহারের জন্য ব্যবহার করবেন, কোনও তৃতীয় পক্ষের পক্ষে বা সুবিধার জন্য নয় এবং কেবলমাত্র এই শর্তাবলী, নীতিমালা এবং আপনার জন্য প্রযোজ্য সমস্ত আইন ও বিধি মেনে চলবেন। যদি আপনার পরিষেবাগুলির ব্যবহার কোনও প্রযোজ্য আইন দ্বারা নিষিদ্ধ করা হয়, তাহলে আপনি পরিষেবাগুলি ব্যবহার করার জন্য অনুমোদিত নন। আপনি যদি পরিষেবাগুলি এমনভাবে ব্যবহার করেন যা আইন ভঙ্গ করে তবে আমরা দায়ী থাকব না। পরিষেবার শর্তাবলীতে বর্ণিত অন্যান্য নিষেধাজ্ঞাগুলি ছাড়াও, আপনাকে ওয়েবসাইট বা এর বিষয়বস্তু ব্যবহার করতে নিষেধ করা হয়েছে:

১. যেকোনো বেআইনি উদ্দেশ্যে।

২. অন্যদেরকে যেকোনো বেআইনি কাজ সম্পাদন বা অংশগ্রহণের জন্য অনুরোধ করা।

৩. মিথ্যা বা বিভ্রান্তিকর তথ্য জমা দেওয়া।

৪. যেকোনো অশ্লীল বা অনৈতিক উদ্দেশ্যে।

৫. অন্যদের ব্যক্তিগত তথ্য সংগ্রহ বা ট্র্যাক করা।

৬. স্প্যাম, ফিশ, ফার্ম, অজুহাত বা স্ক্র্যাপ করা।

৭. আমাদের বৌদ্ধিক সম্পত্তি অধিকার বা অন্যদের বৌদ্ধিক সম্পত্তি অধিকার লঙ্ঘন বা লঙ্ঘন করা

৮. আপনি একাধিক অ্যাকাউন্ট তৈরি করবেন না।

৯. যেকোনো ধরণের জাল অর্ডার গ্রহণ করা হবে না এবং পণ্যের ডেলিভারি পেতে গ্রাহকদের কোম্পানির নীতি অনুসারে অর্থপ্রদানের পদ্ধতি বেছে নিতে হবে। উদাহরণ: গ্রাহকরা ইচ্ছাকৃতভাবে অর্ডার নিশ্চিত করার পরেও তা না পেলে তাকে জাল অর্ডার হিসেবে গণ্য করা হবে।

১০. যেকোনো ক্ষতিকারক, অপমানজনক, বিভ্রান্তিকর, মিথ্যা, প্রতারণামূলক, হুমকি, হয়রানিমূলক, মানহানিকর, মানহানিকর, অশ্লীল, অপবিত্র বা অন্যথায় আপত্তিকর বা বৈষম্যমূলক আচরণে জড়িত হওয়া।

১১. আমাদের দ্বারা প্রদত্ত যেকোনো প্রচার, ডিসকাউন্ট বা অন্যান্য সুবিধার অপব্যবহার করা অথবা তালিকাভুক্ত যেকোনো পণ্যের দামে হস্তক্ষেপ করা অথবা তালিকাভুক্তিতে হস্তক্ষেপ করা।

১২. নিষিদ্ধ ব্যবহার লঙ্ঘনের জন্য আমরা পরিষেবা বা সম্পর্কিত যেকোনো ওয়েবসাইটের আপনার ব্যবহার বন্ধ করার অধিকার সংরক্ষণ করি।

বাতিলকরণ:

জোমেক্স তাদের গ্রাহকদের কাছে মানসম্পন্ন এবং খাঁটি পণ্য সরবরাহ করার প্রতিশ্রুতি দেয়। অনুগ্রহ করে মনে রাখবেন যে কিছু অর্ডার থাকতে পারে যা আমরা গ্রহণ করতে অক্ষম এবং বাতিল করতে বাধ্য। আমাদের নিজস্ব বিবেচনার ভিত্তিতে, আমরা যেকোনো কারণে যেকোনো অর্ডার প্রত্যাখ্যান বা বাতিল করার অধিকার সংরক্ষণ করি। কিছু পরিস্থিতিতে আপনার অর্ডার বাতিল হতে পারে যার মধ্যে রয়েছে ক্রয়ের জন্য উপলব্ধ পরিমাণের সীমাবদ্ধতা, পণ্য বা মূল্য নির্ধারণের তথ্যে ভুল বা ত্রুটি বা আমাদের ক্রেডিট এবং জালিয়াতি প্রতিরোধ বিভাগ দ্বারা চিহ্নিত সমস্যা। যেকোনো অর্ডার গ্রহণ করার আগে আমাদের অতিরিক্ত যাচাইকরণ বা তথ্যের প্রয়োজন হতে পারে। আপনার অর্ডারের সমস্ত বা কোনও অংশ বাতিল হলে বা আপনার অর্ডার গ্রহণের জন্য অতিরিক্ত তথ্যের প্রয়োজন হলে আমরা আপনার সাথে যোগাযোগ করব। আপনার ক্রেডিট কার্ড চার্জ করার পরে যদি আপনার অর্ডার বাতিল করা হয়, তাহলে উক্ত পরিমাণ আপনার কার্ড অ্যাকাউন্টে ফেরত পাঠানো হবে।

রিটার্ন নীতি:

আমরা চাই আপনি পরিষেবাগুলির মাধ্যমে আপনার কেনাকাটায় সন্তুষ্ট থাকুন। জোমেক্স থেকে কেনা সমস্ত পণ্যের জন্য, আপনি রিটার্ন এবং ফেরত পাওয়ার অধিকারী হতে পারেন। আপনি যদি ফেরতের অনুরোধ করতে চান তবে দয়া করে নীতিমালার নির্দেশাবলী অনুসরণ করুন। আপনি স্বীকার করছেন এবং সম্মত হচ্ছেন যে আমরা রিটার্ন নীতি অনুসারে আপনাকে ফেরত দিতে পারি। রিটার্ন এবং ফেরত সম্পর্কে বিস্তারিত জানতে, দয়া করে আমাদের রিটার্ন নীতি দেখুন।

দায়বদ্ধতার সীমাবদ্ধতা:

জোমেক্স পরিষেবাগুলির প্রাপ্যতা নিরবচ্ছিন্নভাবে নিশ্চিত করার জন্য আমরা আমাদের সর্বোচ্চ চেষ্টা করব এবং ট্রান্সমিশন ত্রুটিমুক্ত থাকবে। তবে, ইন্টারনেটের প্রকৃতির কারণে, এটি নিশ্চিত করা যাবে না। এছাড়াও, মেরামত, রক্ষণাবেক্ষণ বা নতুন সুবিধা বা পরিষেবা প্রবর্তনের জন্য জোমেক্স পরিষেবাগুলিতে আপনার অ্যাক্সেস মাঝে মাঝে স্থগিত বা সীমাবদ্ধ করা হতে পারে। আমরা এই ধরনের স্থগিতাদেশ বা বিধিনিষেধের ফ্রিকোয়েন্সি এবং সময়কাল সীমাবদ্ধ করার চেষ্টা করব। অনুগ্রহ করে এই ধারাটি মনোযোগ সহকারে পড়ুন কারণ এটি আপনার প্রতি কোম্পানির দায়বদ্ধতা সীমিত করে।

(১) পরিষেবাগুলি ব্যবহার করে, আপনি এতদ্বারা স্বীকার করছেন এবং সম্মত হচ্ছেন যে আমরা সাইট এবং অ্যাপ সহ পরিষেবাগুলি "যেমন আছে", "যেমন উপলব্ধ" এবং "সকল ডিফল্ট সহ" ভিত্তিতে কোনও ধরণের ওয়ারেন্টি ছাড়াই প্রদান করছি।

(২) আমরা নিম্নলিখিত বিষয়গুলির জন্য কোনও প্রতিশ্রুতি দিই না এবং স্পষ্টভাবে সমস্ত দায় অস্বীকার করি: (ক) পরিষেবাগুলির মাধ্যমে আপনার কাছে অ্যাক্সেসযোগ্য তৃতীয় পক্ষের দ্বারা সরবরাহিত পণ্য, পরিষেবা, তথ্য, প্রোগ্রামিং বা অন্য কোনও কিছু, (খ) পরিষেবা ব্যবহারের সাথে সম্পর্কিত কোনও তৃতীয় পক্ষের গুণমান বা আচরণ।

(৩) আপনি সম্মত হন যে আইন দ্বারা অনুমোদিত সর্বোচ্চ পরিমাণে, আমরা কোনও দায়বদ্ধতার তত্ত্বের অধীনে আপনার কাছে দায়বদ্ধ থাকব না। পূর্বোক্ত সীমাবদ্ধতা ছাড়াই, আপনি সম্মত হন যে, আইন দ্বারা অনুমোদিত সর্বোচ্চ পরিমাণে, কোম্পানি এবং এর অনুমোদিত সংস্থাগুলি (অন্যান্য জোমেক্স সাইটের অপারেটর সহ) কোনো পরোক্ষ, আনুষঙ্গিক, ফলস্বরূপ, বিশেষ বা দৃষ্টান্তমূলক ক্ষতি, লাভের ক্ষতি, ব্যবসায়িক বাধা, সুনামের ক্ষতি বা আপনার পরিষেবাগুলির ব্যবহার বা ব্যবহারের অক্ষমতার সাথে সম্পর্কিত কোনওভাবে ডেটা ক্ষতির জন্য দায়বদ্ধ থাকবে না।

কর:

আপনি সম্মত হচ্ছেন যে জোমেক্স, এর কর্মচারী, পরিচালক, কর্মকর্তা, এজেন্ট এবং তাদের উত্তরসূরি এবং বরাদ্দকৃতদের ক্ষতিপূরণ দিতে এবং ক্ষতিহীন রাখতে, আপনার কর্ম বা নিষ্ক্রিয়তার উপর ভিত্তি করে দাবির কারণে বা এর ফলে উদ্ভূত যেকোনও এবং সমস্ত দাবি, দায়, ক্ষতি এবং খরচ, আইনজীবীর ফি সহ ক্ষতিপূরণ দিতে সম্মত হচ্ছেন, যার ফলে জোমেক্স বা কোনও তৃতীয় পক্ষের কোনও ক্ষতি বা দায়বদ্ধতা হতে পারে, যার মধ্যে কোনও ওয়ারেন্টি, প্রতিনিধিত্ব বা উদ্যোগ লঙ্ঘন অন্তর্ভুক্ত কিন্তু সীমাবদ্ধ নয় অথবা এই ব্যবহারকারী চুক্তির অধীনে আপনার কোনও বাধ্যবাধকতা পূরণ না করার সাথে সম্পর্কিত বা বৌদ্ধিক সম্পত্তি অধিকার, আইনী বকেয়া এবং কর প্রদান, মানহানির দাবি, মানহানি, গোপনীয়তা বা প্রচারের অধিকার লঙ্ঘন, অন্যান্য গ্রাহকদের দ্বারা পরিষেবা হারানো এবং মেধা সম্পত্তি বা অন্যান্য অধিকার লঙ্ঘন অন্তর্ভুক্ত তবে সীমাবদ্ধ নয় এমন কোনও প্রযোজ্য আইন, প্রবিধান লঙ্ঘনের ফলে উদ্ভূত। এই ধারাটি এই ব্যবহারকারী চুক্তির মেয়াদ শেষ হওয়া বা সমাপ্তির পরেও টিকে থাকবে।

সমাপ্তি:

আপনার বা জোমেক্স এর দ্বারা ব্যবহারকারীর চুক্তির যেকোনও বাতিলকরণের ক্ষেত্রে, আপনাকে অবশ্যই এই সাইট থেকে ডাউনলোড করা বা অন্যথায় প্রাপ্ত সমস্ত উপকরণ, সেইসাথে ব্যবহারকারীর চুক্তির অধীনে তৈরি বা অন্যথায় তৈরি করা সমস্ত উপকরণের সমস্ত অনুলিপি অবিলম্বে ধ্বংস করতে হবে। এই ব্যবহারকারীর চুক্তির যেকোনও অবসানের পরেও জোমেক্স এর যেকোনো মন্তব্যের অধিকার থাকবে। ব্যবহারকারীর চুক্তির এই ধরনের কোনও অবসান সাইট থেকে ইতিমধ্যে অর্ডার করা পণ্যের জন্য অর্থ প্রদানের আপনার বাধ্যবাধকতা বাতিল করবে না বা ব্যবহারকারীর চুক্তির অধীনে উদ্ভূত কোনও দায়কে প্রভাবিত করবে না।

Zomex holds the right to change/revise/modify any discount offers or promotional allowances without prior notice. Customers can not avail multiple discount offers in a single order.

Fraudulent/Declined Transactions:

Zomex reserves the right to recover the cost of goods collection charges and lawyers’ fees from persons using the Site fraudulently Zomex reserves the right to initiate legal proceedings against such persons for fraudulent use of the site and any other unlawful acts or omissions in breach of these terms and conditions.
